NoshRocket operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). NoshRocket is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. Nothing in these Terms affects your statutory rights as a consumer under UK law. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age.

 

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete.

 

You are solely responsible for maintaining the security of your account credentials and for all of your account activity.

SECTION 2 - OUR PRODUCTS AND ALLERGEN INFORMATION

We have made every effort to provide an accurate representation of the products and services in our online stores.

  • 2.1 Frontend Allergen Displays: To assist you in making informed choices, we display explicit allergen disclosures across our product pages via dedicated product metadata fields. These lists reflect the ingredient and allergen declarations provided directly to us by our partner kitchens and merchants.

  • 2.2 Preparation Disclaimer: While allergen information is written clearly on the product pages, you acknowledge that all hot food and bespoke menu items are prepared, cooked, and packaged by individual partner kitchens, not by NoshRocket.

  • 2.3 Cross-Contamination Liability: Because we do not handle or prepare the food items directly, NoshRocket cannot guarantee that a partner merchant's kitchen environment is completely free from airborne allergens or cross-contamination. If you suffer from a severe, life-threatening food allergy or intolerance, you must contact the producing restaurant directly to verify their active kitchen safety protocols before placing your order via our Services.

  • 2.4 Specification Changes: All descriptions of products, ingredients, and associated allergen data are subject to change at any time without notice based on merchant recipe updates. We reserve the right to discontinue any product or service at any time.

SECTION 3 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. NoshRocket reserves the right to accept or decline your order for any reason. Your order is not accepted until confirmation is sent. We must receive and process your payment before your order is accepted.

Perishable Goods Waiver: In accordance with Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory 14-day cooling-off/cancellation period does not apply to the supply of goods that are liable to deteriorate or expire rapidly (such as fresh or hot food). Once an order has been accepted and preparation has commenced, it cannot be cancelled or refunded except at our absolute discretion.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Posted prices include VAT where applicable but exclude specific service charges or delivery fees, which are calculated and clearly displayed at checkout.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores.

SECTION 5 - DELIVERY AND RISK

In accordance with the UK Consumer Rights Act 2015, the risk of loss, damage, or deterioration of the products remains with us until the physical items are delivered into your possession at the designated delivery address.

While we make every effort to meet estimated delivery times, all times provided are estimates only. We are not liable for reasonable delivery delays caused by traffic, weather, or operational issues outside our control.

Where possible, our courier will attempt to contact you via phone before marking a delivery as undelivered. We will make 2 door knocks or bell rings before calling you. If there is still no response, your order will be left at the doorstep or building entrance at the delivery address given. A proof of delivery image will be taken by the courier and the order will then be marked as complete on the driver delivery app. You will remain liable for the full cost of the order.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, and the design, selection, and arrangement thereof, are owned by NoshRocket, its affiliates or licensors and are protected by United Kingdom and international copyright, trademark, and intellectual property laws.

SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide you with access to third-party tools or links to third-party websites which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or endorsements of any kind. Any use by you of optional third-party elements is entirely at your own risk.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

NoshRocket is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with NoshRocket. You acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and NoshRocket.

SECTION 9 - ERRORS AND INACCURACIES

Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, offers, or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

 

SECTION 10 - PROHIBITED USES AND AUTOMATED AGENTS

You may access and use the Services for lawful purposes only. You agree not to use any robot, spider, scraping tool, data gathering extraction tool, or automated software agent to access, harvest, or manipulate the Services without our explicit prior written consent.

Any authorized software agent accessing the services must clearly identify its name within its user-agent string and must not attempt to circumvent security measures or CAPTCHAs.

SECTION 11 - LIMITATION OF LIABILITY

Nothing in these Terms of Service shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

Subject to the above, NoshRocket shall not be liable for any indirect, incidental, or consequential losses, or lost profits arising from your use of the services or products procured through the platform. To the fullest extent permitted by law, NoshRocket's total liability to you shall not exceed the value of the order giving rise to the claim.

SECTION 12 - SEVERABILITY AND ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right. If any provision of these Terms is determined to be unlawful, void or unenforceable by a court of law, such provision shall be severed, and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

SECTION 13 - GOVERNING LAW

These Terms of Service, their subject matter, and their formation (including any non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales. You and NoshRocket both agree that the courts of England and Wales will have exclusive jurisdiction over any disputes arising under or in connection with these terms.
