  1. About NoshRocket

NoshRocket provides ordering assistance, personal shopping, personal courier and local collection and delivery services.

Depending on the service selected, NoshRocket may act:

  • as an ordering and delivery service between a customer and an independent restaurant, retailer or other vendor;
  • as the customer’s disclosed agent when sourcing and purchasing goods through the Personal Shopper service; or
  • as a local courier carrying an approved item from one location to another.

The identity of the seller of any goods remains the relevant restaurant, retailer or vendor. Unless expressly stated otherwise, NoshRocket does not manufacture, prepare or resell those goods.

Further information about each service is contained in our Terms of Service, Shipping and Delivery Policy, Returns, Refunds and Cancellation Policy, Allergen Advice and other applicable policies.

  1. Personal Shopper purchases

When using the Personal Shopper service, the customer appoints NoshRocket to arrange for an authorised Personal Shopper to locate and purchase goods on the customer’s behalf.

The customer does not purchase those goods from NoshRocket. The contract for the goods is between the customer and the retailer or vendor from whom they are purchased, subject to that vendor’s applicable terms.

NoshRocket receives the customer’s money so that the authorised Personal Shopper can make the purchase as the customer’s agent. The customer will receive the retailer’s original receipt, which shows the price charged by the retailer. NoshRocket’s separate charges, including the Personal Shopper percentage fee and delivery charges, will be shown through the NoshRocket checkout or order confirmation.

Only authorised NoshRocket Personal Shoppers may carry out the shopping portion of this service. A delivery driver may be assigned to collect the completed order from the Personal Shopper and transport it to the customer but is not authorised to select or purchase the goods.

  1. Independent vendors

Restaurants, shops and other vendors appearing on or accessible through NoshRocket are independent businesses.

Unless expressly stated otherwise, NoshRocket does not own, operate, manage or control those businesses. References to a vendor on our website do not create a partnership, joint venture, employment relationship, franchise or endorsement arrangement.

Each vendor remains responsible for:

  • the goods it sells;
  • the accuracy of its product information;
  • its prices and availability;
  • food preparation and packaging;
  • ingredients and allergen information supplied by it;
  • product quality and legal compliance; and
  • any warranties or statutory obligations applying to it as the seller.

NoshRocket remains responsible for carrying out its own services with reasonable care and skill.

  1. Prices and payments

Prices, service fees, shopping fees, delivery charges and any other applicable costs will be displayed or communicated before the customer commits to the relevant order, wherever reasonably possible.

Vendor prices and product availability may change without notice. For Personal Shopper orders, substitutions, unavailable items or price differences may require the customer’s approval and additional payment before purchase.

NoshRocket is not responsible for pricing errors made by an independent vendor, but we will take reasonable steps to help the customer raise the issue with that vendor.

  1. Allergen and dietary information

Allergen and dietary information displayed by NoshRocket is based on information supplied or published by the relevant vendor or manufacturer.

NoshRocket does not independently test food, inspect kitchens or verify recipes. We do not infer allergens from a product name, image or general description.

Where a vendor does not publish product-specific allergen information or an allergen matrix, NoshRocket may be unable to display that information. This omission does not mean that the product is free from allergens.

Customers with an allergy, intolerance or other dietary requirement must read our Allergen Advice and contact the relevant vendor directly before ordering. Cross-contamination may occur in food preparation, retail, shopping and delivery environments.

  1. Age-restricted goods

Age-restricted goods are governed by our Age-Restricted Goods Policy.

Customers must be at least 18 years old and must satisfy our Challenge 25 procedures where applicable. Suitable identification may be required when an order is placed and when it is handed over.

Age-restricted goods will not be left unattended or delivered to a person who cannot provide satisfactory identification.

  1. Website information

We take reasonable care to keep the information on noshrocket.co.uk accurate and current. However, product details, opening hours, availability, prices, menus, delivery estimates and vendor information may be supplied by third parties and may change without notice.

Website content is provided for general information and service administration. It is not professional, medical, nutritional or legal advice.

If you notice inaccurate information, please contact us so that we can investigate and correct it where appropriate.

  1. Service availability

Access to the website or NoshRocket services may occasionally be interrupted because of maintenance, technical problems, adverse weather, traffic, vendor delays, driver availability, events outside our reasonable control or other operational reasons.

We do not guarantee that every service, vendor or product will be available at all times or at every address.

  1. External links

Our website may contain links to websites, payment services, maps, social media platforms or other services operated by third parties.

These external services are controlled by their respective operators. NoshRocket is not responsible for their content, availability, security or privacy practices. A link does not necessarily mean that NoshRocket endorses the third party or its services.

Customers should review the third party’s own terms and privacy information before using an external service.

  1. Intellectual property

Unless otherwise stated, the NoshRocket name, branding, website design, original written content, graphics and other materials created for NoshRocket belong to Barry James trading as NoshRocket or are used with the permission of the relevant owner.

You may view or print reasonable extracts for your own personal and non-commercial use.

You must not copy, reproduce, republish, distribute, sell, modify or commercially exploit NoshRocket content without prior written permission, except where permitted by law.

Product names, restaurant names, logos and trademarks belonging to independent vendors remain the property of their respective owners.

  1. Prohibited website use

You must not:

  • use the website unlawfully or fraudulently;
  • attempt to gain unauthorised access to the website or associated systems;
  • introduce viruses, malware or other harmful material;
  • interfere with the website’s operation or security;
  • collect information about other users without lawful authority;
  • impersonate another person or provide false information; or
  • use NoshRocket content in a misleading way.

We may suspend or restrict access where reasonably necessary to protect customers, vendors, drivers, shoppers, NoshRocket or the security of the service.

  1. Liability

Nothing in this Legal Notice excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

NoshRocket is not responsible for losses that were not reasonably foreseeable when the relevant contract was formed or for losses caused by inaccurate information, defective goods or other failures attributable to an independent vendor.

NoshRocket is not liable for business losses suffered by a consumer, including loss of profit, revenue, business, opportunity or anticipated savings.

Nothing in this Legal Notice affects a customer’s statutory rights or any responsibility NoshRocket has to provide its own services with reasonable care and skill.

Detailed provisions concerning responsibility, refunds, cancellations and delivery are contained in the relevant NoshRocket policies and Terms of Service.

Personal information is processed in accordance with our Privacy Policy.

Information about cookies and similar technologies is contained in our Cookie Policy.

The latest version will be published on noshrocket.co.uk with its revision date. Changes will apply from the date they are published and will not retrospectively remove rights already acquired under an existing order.

  1. Governing law

This Legal Notice and the use of the NoshRocket website are governed by the laws of England and Wales.

Consumers living elsewhere in the United Kingdom retain any mandatory rights and protections available under the laws applying to them.

The courts of England and Wales will have jurisdiction, subject to any rights a consumer has to bring proceedings in another part of the United Kingdom.
